Aspire Performance & Nutrition
These Terms of Service ("Terms") govern your access to and use of Aspire Performance & Nutrition (the "Platform"), including our website, subscription content, interactive tools, courses, and printable materials (collectively, the "Services"). The Platform is owned and operated by Luke Rodriguez, MS, RDN ("Aspire," "we," "us," or "our") in Colorado.
By accessing or using the Services, creating an account, or purchasing a subscription, you agree to these Terms. If you do not agree, do not use the Services.
1.1 Binding Agreement. These Terms form a legally binding agreement between you and Aspire.
1.2 Eligibility. You must be at least 18 years old to create an account in your own name unless you are an eligible minor user as described in Section 3.
1.3 Authority. If you are using the Services on behalf of a school, team, organization, or other entity, you represent you have authority to bind that entity to these Terms.
2.1 Educational Platform. Aspire provides general sports nutrition education for high school track & field and cross country coaches, athletes, and parents, including 300 evidence-based articles, interactive tools, a coaching course, and printable handouts.
2.2 No Medical Nutrition Therapy. Aspire does not provide Medical Nutrition Therapy ("MNT"), medical advice, diagnosis, or treatment. See Section 12 (Medical Disclaimer).
2.3 Food-First Approach. Aspire's content and tools provide food-based educational recommendations and do not prescribe supplements or individualized calorie prescriptions.
3.1 Account Registration. To access certain features, you may be required to create an account. You agree to provide accurate information and to keep it updated.
3.2 Account Security. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.
3.3 Users Under 18. If you are under 18, you should have your parent or guardian review these Terms. By creating an account, you represent that you have their permission to use the Platform or that you are 18 or older. We do not currently collect date of birth or separate guardian consent; account creation is self-service.
3.4 Under 14. The Services are not directed to children under 13. We do not knowingly permit account creation by children under 13. If we learn we have collected personal information from a child under 13 without verifiable parental consent, we will delete it.
4.1 Subscription Plans. Aspire offers subscription tiers, which may include: Parent & Athlete Access: $14/month or $119/year for one household; Program Access: $590/year for one XC/track program (legacy monthly plans may remain active for existing subscribers); and optional 1:1 coaching services with separate pricing. Prices are subject to change; the current price at the time of purchase controls.
4.2 Payment Processor. Payments are processed through third-party payment providers (e.g., Stripe). You agree to the processor's terms as applicable.
4.3 Auto-Renewal. Subscriptions renew automatically unless canceled before the renewal date.
4.4–4.7. Billing cycles, taxes, price changes, and failed payment handling are as described at the time of purchase.
5.1 Cancel Anytime (Monthly). You may cancel a monthly subscription at any time; cancellation takes effect at the end of the current billing period.
5.2 Annual Plans. Annual subscriptions remain active through the end of the annual term unless otherwise required by law.
5.3 Refund Policy. Except where required by law, fees are non-refundable, including partially used billing periods.
5.4 Termination by Aspire. We may suspend or terminate your access if you violate these Terms, misuse the Platform, or engage in fraudulent or unlawful conduct.
You agree to use the Services only for lawful purposes. Parent Access is limited to one household. You may not share your login credentials or allow persons outside your household to access your account; doing so is a material breach and may result in termination of access without refund. You may not: share or resell access except as expressly allowed under Program Access; copy, reproduce, distribute, or create derivative works; attempt to reverse engineer, scrape, or disrupt the Platform; upload malware or attempt unauthorized access; or use the Platform to provide medical advice or represent that Aspire content is medical guidance.
You may optionally input training logs, body weight, symptom checklists, and other information. Inputs are used to provide educational outputs. Submission of inputs does not create a dietitian–patient relationship. Aspire does not review inputs for medical safety. You retain ownership of your inputs and grant Aspire a limited license to use them to operate and improve the Services. Aspire does not sell personal data for monetary consideration.
All content is owned by Aspire or its licensors. You receive a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, educational purposes. You may not reproduce, distribute, publicly display, or create derivative works except as permitted.
The Services are provided "AS IS" and "AS AVAILABLE." Aspire disclaims all warranties, express or implied. We do not guarantee uninterrupted access or error-free operation.
Aspire will not be liable for indirect, incidental, special, consequential, or punitive damages. Total liability will not exceed the amount you paid in the 12 months before the event (or $100 if you have not paid anything).
You agree to indemnify and hold harmless Aspire from any claims arising from your misuse of the Services, violation of these Terms, or violation of any law or third-party rights.
Aspire provides general sports nutrition education only. Not medical advice. No individualized MNT or dietitian–patient relationship. Always seek qualified physician advice regarding medical conditions. Do not use the Services for emergencies. Call 911.
Tool outputs are educational estimates, not prescriptions. Food-first education only; no calorie or supplement prescriptions. Athletes vary; you decide how to apply outputs. Physician visit prep reports are intended to help organize questions—not medical advice.
Program Access grants unlimited authorized user accounts for the covered program during the license term. Authorized users include coaches/staff, athletes (14–18 with parental consent), and parents/guardians. School may designate an admin to manage access. Accounts may not be shared outside the covered program.
